Terms of Use
Access to and use of the site, pql.org.uk, or any other site operated by Professional Qualifications Limited, hereinafter referred to as ‘PQL’, is provided subject to the following terms:
By using pql.org.uk you agree to be legally bound by these terms, which shall take effect immediately on your first use of pql.org.uk. If you do not agree to be legally bound by all of the following terms, please do not access and/or use the facilities within pql.org.uk.
PQL may change these terms at any time by posting changes online. Please review these terms regularly to ensure you are aware of any changes made by PQL. Your continued use of pql.org.uk after changes are posted means you agree to be legally bound by these terms as updated and/or amended.
Use of the pql.org.uk learning portal
Your user account is for your own personal use only. It is non-transferable, and the sharing of accounts is expressly forbidden under the terms of this agreement. PQL reserves the right to suspend any accounts that breach this agreement.
You may not copy, reproduce, distribute, republish, download, post, broadcast, transmit, make available to the public, or otherwise use pql.org.uk courses and content in any way except for your own studies and personal, non-commercial use. Any other use of pql.org.uk content requires the prior written permission of PQL.
You agree to use pql.org.uk only for lawful purposes and in a way that does not infringe the rights of, restrict or inhibit anyone else's use and enjoyment of the PQL learning portal. Prohibited behaviour includes harassing or causing distress or inconvenience to any person, transmitting / posting obscene or offensive content or disrupting the studies of others who use pql.org.uk
Disclaimers and Limitation of Liability
PQL content, including study material, information, assessments, assignments, audio and video content, text, names, images, pictures, logos and icons regarding or relating to the various courses and services contained within the PQL learning portal is the intellectual property of PQL and/or approved third-party authors or other third-parties. It is provided "as seen" and on an "as available" basis without any representations or any kind of warranty made (whether express or implied by law) to the extent permitted by law, including the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, security and accuracy.
Under no circumstances will PQL be liable for any of the following losses or damage (whether such losses where foreseen, foreseeable, known or otherwise): (a) loss of data; (b) loss of revenue or anticipated profits; (c) loss of business; (d) loss of opportunity; (e) loss of goodwill or injury to reputation; (f) losses suffered by third parties; (g) failure to pass any assessment, assignment or examination; (h) failure to achieve, attain or obtain a qualification or award; (i) any indirect, consequential, special or exemplary damages arising from the use of pql.org.uk regardless of the form of action.
Whilst our servers are virus checked and monitored on a regular basis, there are factors out with our control that may affect the reliability and connectivity to the Internet. PQL does not warrant that functions contained in the pql.org.uk learning portal, its content or any other website operated by PQL will be uninterrupted or error free, that defects will be corrected, or that pql.org.uk, the server, or any other website or server operated by PQL are free of viruses or bugs.
Intellectual Property
All content, names, images and logos identifying PQL, its courses and services and all third parties and their products and services, are subject to copyright, design rights and trade marks (whether established or pending) of PQL and/or accredited, licensed or approved third-parties. Nothing contained in these terms shall be construed as conferring by implication, estoppel or otherwise any licence or right to use any trademark, patent, design right or copyright of the PQL or any other third party.
Contributions to pql.org.uk and relevant third-parties
Where you are invited to submit any contribution to pql.org.uk (including any text, coursework, photographs, graphics, assignments, assessments, video or audio) you agree, by submitting your contribution, to grant PQL the right to make this contribution available to the relevant Professional Body, Awarding Body or other third-party who may require access to such contributions in order to make a judgement or decision on whether to make specific qualification or other awards to you. You also agree to grant PQL a perpetual, royalty-free, non-exclusive, sub-licensable right and license to use, reproduce, distribute and exercise all copyright and publicity rights with respect to other relevant contributions worldwide and in accordance with privacy restrictions set out in PQL’s privacy policy. By submitting any contribution, you agree that your contribution is your own original work and you have the right to make it available to PQL for the purposes specified above. You also agree that it is not defamatory, it does not infringe any law, it is not the result of plagiarism and you agree to indemnify PQL against all legal fees and damages and other expenses that may be incurred by PQL as a result of your breach of the above warranty.
Safety
When using pql.org.uk, we advise that you do not reveal any personal information about yourself, or anyone else, to other students not known to you who also use the PQL learning portal.
Legal compliance
- You may not submit any defamatory or illegal material of any nature in the community section of pql.org.uk. This includes text, graphics, video, programs or audio.
- Contributing material with the intention of committing or promoting an illegal act is strictly prohibited.
- You agree to only submit materials which are your own original work. You must not violate, plagiarise, or infringe the rights of third parties including copyright, trade mark, trade secrets, privacy, publicity, personal or proprietary rights.
- The views expressed by you and other students in pql.org.uk Community areas are not necessarily those of PQL.
If you're under 16:
- Please get a parent’s or guardian’s permission before taking part in any pql.org.uk discussion.
- Never reveal any personal information about yourself, or other people, to other students or other parties unknown to you who use the PQL learning portal. Do not divulge your name, address, telephone number, email address or other personal contact information.
Community Rules
You agree to use pql.org.uk community facilities, including Message Boards, Forum, Chat, email etc. in accordance with the following Community Rules. These apply across all PQL community sites and services.
About your posts to Forums, Chat or other communication facilities:
- Contributions must be civil, non-abusive and non-offensive.
- No unlawful or objectionable content: Please note that unlawful, harassing, defamatory, abusive, threatening, harmful, obscene, profane, sexually oriented, racially offensive or otherwise objectionable material is not acceptable.
- Be patient: users of all ages and abilities may be taking part in relevant discussions to facilitate and assist their studies.
- No spamming or non–relevant off-topic material: Please do not re-submit your contribution to more than one discussion, or contribute non-relevant off-topic material in subject-specific areas. Do not contact other members or tutors by email with non-relevant email and do not disclose or divulge the email addresses of yourself or others to any third-party.
- No advertising
- No impersonation: Do not pretend that you are someone else.
- No inappropriate (e.g. vulgar, offensive etc) user names
PQL’s judgement on these matters is final and conclusive
If you breach these Terms of Use:
If you fail to abide by these Community Rules when using or contributing to any pql.org.uk Forum, Chat, email or other communication or Community facility, you will be sent an e-mail which informs you why your contribution has been edited or deleted. This mail will also include a warning that continuing to break the rules may result in action being taken against your account or accounts.
This action may include your relevant account or accounts being placed into pre-moderation or a temporary or permanent suspension of your ability to participate in any or all of PQL Community areas.
If you post or send offensive or inappropriate content anywhere on or to PQL Community facilities or otherwise engage in any disruptive behaviour on pql.org.uk or any other PQL website, and PQL considers such behaviour to be serious and/or repeated, PQL may use whatever information that is available to it about you to stop any further such infringements. This may include informing relevant third parties such as the Professional or Awarding Body who’s course or qualification that you are studying towards, your employer, school, college, university or other training provider about the infringement/s.
PQL reserves the right to delete any contribution, or take action against any account, at any time, for any reason.
General
If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the laws of any state or country in which these terms are intended to be effective, then to the extent and within the jurisdiction in which that term is illegal, invalid or unenforceable, it shall be severed and deleted from these terms and the remaining terms shall survive, remain in full force and effect and continue to be binding and enforceable.
These terms shall be governed by and interpreted in accordance with the laws of Scotland.
